1. Introduction
These Terms and Conditions govern your use of the Climb Mount Kenya website (climbmountkenya.org) and the booking of guided trekking services operated by Climb Mount Kenya ("we", "us", "our"), based in Nanyuki, Kenya. By accessing this website or booking a trek, you agree to be bound by these terms.
2. Booking and Payment
All trek bookings are subject to availability and confirmation by our team. A non-refundable deposit of 30% of the total trek cost is required to secure your booking. The remaining balance is due 30 days before the trek start date. Payments can be made via bank transfer, M-Pesa, or international wire transfer. All prices are quoted in US Dollars (USD) unless otherwise stated. Kenyan citizen and resident rates are available with valid identification.
3. Cancellation Policy
Cancellations made more than 60 days before the trek start date will receive a full refund minus the 30% deposit. Cancellations made 30–60 days before the start date will receive a 50% refund of the total amount paid. Cancellations made less than 30 days before the start date are non-refundable. We strongly recommend purchasing travel insurance that covers trip cancellation. If we cancel a trek due to unsafe conditions (severe weather, KWS park closure), you will receive a full refund or the option to reschedule at no additional cost.
4. Trek Requirements
All trekkers must be in reasonable physical health. We reserve the right to refuse participation to anyone whose health condition poses a risk to themselves or the group. Trekkers under 16 must be accompanied by a parent or guardian. A KWS-registered guide is mandatory for all treks above the forest line — this is a Kenya Wildlife Service requirement, not optional. You must carry valid identification (passport for international visitors, national ID for Kenyan citizens) for park entry.
5. Safety and Liability
Mountain trekking involves inherent risks including altitude sickness, adverse weather, wildlife encounters, and physical injury. By booking a trek, you acknowledge these risks and agree that Climb Mount Kenya is not liable for injuries, illness, or death resulting from inherent mountain risks. Our guides are Wilderness First Aid certified and carry emergency communication equipment. We include mountain rescue insurance in all packages. However, we reserve the right to make decisions regarding route changes, summit turnarounds, and emergency descents — our guides' safety decisions are final and non-negotiable.
6. What's Included
Unless otherwise specified, our trek packages include: KWS park entry fees, professional guide and porter team, all meals on the mountain, camping or hut accommodation, transport to and from the park gate, cooking equipment and camping gear, and mountain rescue insurance. Packages do not include: personal travel insurance, flights or transport to Nanyuki, personal gear (sleeping bag, clothing, boots), tips for guides and porters, alcoholic beverages, or any items of a personal nature.
7. Environmental Responsibility
We operate under a strict Leave No Trace policy. All waste is carried out of the park. Trekkers must not disturb wildlife, pick plants, or leave litter on the trail. We reserve the right to terminate a trek without refund if a participant deliberately damages the park environment.
8. Photography and Content
By participating in a trek, you consent to being photographed or filmed for promotional purposes unless you inform us in writing before the trek. You retain full ownership of your own photographs and videos taken during the trek.
9. Intellectual Property
All content on this website — text, images, data, design, and code — is the property of Climb Mount Kenya and is protected by copyright. You may not reproduce, distribute, or commercially use any content without written permission.
10. Governing Law
These terms are governed by the laws of the Republic of Kenya. Any disputes arising from these terms or our services shall be subject to the jurisdiction of the courts in Nanyuki, Laikipia County, Kenya.
11. Changes to Terms
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of the website after changes constitutes acceptance of the revised terms.
